Terms of Service

Welcome to Connektflow. These Terms of Service ("Terms") govern your access to and use of the Connektflow platform and services provided by Adify360 LLP ("we," "us," "our," or "Connektflow"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Connektflow, you confirm that:

• You are at least 18 years old
• You have authority to enter these Terms on behalf of your business
• You will use the Service in compliance with applicable laws
• You have read and agreed to our Privacy Policy

2. Description of Service

Connektflow is a customer messaging platform that integrates with WhatsApp Business API, Instagram Messaging, Email, and Shopify to provide:

• Unified inbox for customer conversations
• Automated messaging workflows (order confirmations, shipping updates, cart recovery)
• Customer data management and analytics
• Multi-channel broadcast capabilities

3. Account Registration

You must provide accurate, current, and complete information during registration. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Immediately notifying us of any unauthorized access

4. Acceptable Use

You agree NOT to use Connektflow to:

• Send spam, unsolicited, or deceptive messages
• Violate any third-party rights or applicable laws
• Send illegal, harmful, harassing, or obscene content
• Impersonate others or misrepresent your identity
• Interfere with or disrupt the Service or networks
• Attempt to gain unauthorized access to systems or data
• Reverse engineer, decompile, or extract source code
• Use the Service to compete with Connektflow

You must comply with WhatsApp Business Messaging Policy, Instagram API Terms, and all platform terms.

5. Third-Party Integrations

Connektflow integrates with third-party services (Shopify, Meta platforms, email providers). Your use of these integrations is also subject to their respective terms. We are not responsible for third-party services or their availability.

6. Subscription, Fees, and Payment

• Subscription fees are billed in advance based on your chosen plan
• Usage-based charges (message volumes) are billed monthly in arrears
• All fees are non-refundable except as required by law
• We may update pricing with 30 days advance notice
• Late payments may result in service suspension

7. Intellectual Property

All Connektflow content, features, and functionality are owned by Adify360 LLP and protected by intellectual property laws. You receive a limited, non-exclusive license to use the Service during your subscription term.

You retain ownership of content you upload ("Your Content"). You grant us a license to use Your Content solely to provide the Service.

8. Data and Privacy

Your data is handled according to our Privacy Policy. You are responsible for:

• Obtaining consent from your customers before messaging them
• Compliance with data protection laws (GDPR, India DPDPA, etc.)
• Respecting opt-out requests promptly

9. Service Availability

We strive for high uptime but do not guarantee uninterrupted service. We may perform maintenance with prior notice. Extended outages will be communicated.

10. Suspension and Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Fail to pay fees
• Engage in fraudulent or illegal activity
• Put our systems or other customers at risk

You may cancel your subscription at any time. Upon termination, you lose access to the Service and we may delete your data per our retention policy.

11. Warranties and Disclaimers

The Service is provided "AS IS" without warranties of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, Adify360 LLP shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability is limited to the amount you paid us in the preceding 12 months.

13. Indemnification

You agree to indemnify Adify360 LLP against claims arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of third-party rights
• Content you submit or communicate through the Service

14. Governing Law

These Terms are governed by the laws of India. Disputes shall be resolved in courts located in Jaipur, Rajasthan, India.

15. Changes to Terms

We may update these Terms periodically. Material changes will be notified 30 days in advance. Continued use after changes constitutes acceptance.
